What to expect when you no longer reside with the other parent of your children, and how to protect your rights.
Paternity actions fall under the larger umbrella of family law. It applies to parents who are not married to each other but have a child or children together, and are now separated, or a separation is imminent. Finding a knowledgeable, dedicated attorney to represent your interests when you need to establish the paternity of a child, a parenting plan and a child support order is incredibly important for a continued relationship with the child, and long-term finances.
The trend in the State of Florida is to grant both parents similar time-sharing. There are exceptions to that trend, and they flow from the “best interest of the child” standard. An absentee parent, or one who’s work schedule is unable to accommodate this arrangement would not be given equal time-sharing. Child support is calculated by statute in Florida, it is based on the number of overnights each parent has with the child, the income of both parties, health insurance payments, and some other criteria that is not frequently utilized like mandatory union dues. The number of overnights each party has with their child or children plays a big role in how much child support exchanges hands. Additionally, parties are expected to split things like extracurricular activities and out-of-pocket medical, dental, vision, and orthodontia expenses, just to name a few. Without a knowledgeable attorney by your side, you could end up with less than desired time-sharing and a child support order you weren’t anticipating. The burden to change these agreements later is difficult. There must be a substantial material change that wasn’t anticipated at the time of the original agreement.
